Article 1 – Company details and definitions
SchminkenGrime.nl is a trade name of Schmink en Grime, established in Vught, the Netherlands.

In these General Terms and Conditions, the following definitions apply:
- SchminkenGrime.nl: the seller and user of these General Terms and Conditions.
- Customer: any natural person or legal entity entering into an agreement with SchminkenGrime.nl.
- Consumer: a natural person acting for purposes outside their trade, business, craft or profession.
- Business customer: a customer acting in the exercise of a trade, business, craft or profession.
- Agreement: any agreement between SchminkenGrime.nl and the customer for the supply of products or services.
- Webshop: the online shop of SchminkenGrime.nl.
Where provisions apply specifically to consumers or business customers, this is expressly stated.
Article 2 – Applicability
- These General Terms and Conditions apply to offers, orders and agreements of SchminkenGrime.nl, unless otherwise agreed in writing.
- The General Terms and Conditions are made available before an agreement is concluded and can be viewed and saved via the webshop.
- If any provision of these General Terms and Conditions conflicts with mandatory law, the statutory provision will prevail.
- If any provision is wholly or partly invalid or unenforceable, the remaining provisions will remain in force.
- In relation to business customers, any general terms and conditions of the business customer are expressly rejected unless SchminkenGrime.nl has agreed in writing to their applicability.
- Information that must legally be provided separately to the customer before or after conclusion of the agreement is also made available through the webshop and the ordering process.
Article 3 – Offer, order and conclusion of the agreement
- SchminkenGrime.nl takes care to present the offer, product information, images, prices and other information in the webshop as fully and accurately as possible.
- Obvious errors, mistakes or typographical errors are not binding on SchminkenGrime.nl if it should reasonably have been clear to the customer that an error had occurred.
- After the customer places an order, the customer receives an electronic confirmation of the order.
- The agreement is concluded when SchminkenGrime.nl accepts the order. The electronic order confirmation may show that the order has been accepted.
- Until the moment of acceptance, SchminkenGrime.nl may refuse an order where there is a justified reason, for example where a product is unavailable, an obvious error has occurred or there are reasonable indications of fraud or misuse.
- If, after conclusion of the agreement, an order unexpectedly cannot be delivered in whole or in part, SchminkenGrime.nl will contact the customer. Depending on the situation, the customer may choose to wait, accept a suitable alternative, or receive a refund for the unavailable product.
- SchminkenGrime.nl will not send a different product as a replacement without the customer’s consent.
Article 4 – Prices
- Prices shown in the webshop for consumers include VAT, unless expressly stated otherwise.
- Any shipping costs and other additional charges are clearly displayed before the order is completed.
- Current shipping costs and any thresholds for free shipping are shown on the Ordering and Shipping page and during checkout.
- Obvious pricing errors or other clear mistakes are not binding on SchminkenGrime.nl if the customer could reasonably understand that the stated price was incorrect.
- Price changes do not affect agreements already concluded.
Article 5 – Payment
- The available payment methods are displayed during checkout. Which payment methods are available may depend on the country, the order and the payment service provider used.
- Where a payment method requires immediate payment, the order is processed after the payment has been successfully completed.
- For payment by bank transfer, the order is processed after payment has been received by SchminkenGrime.nl.
- Where payment after delivery is offered, the terms and conditions of the relevant payment service provider may also apply.
- For business customers for whom payment on account has been agreed in writing, the payment term stated on the invoice applies.
- In the event of late payment by a consumer, statutory interest and extrajudicial collection costs will only be charged after the applicable statutory requirements have been met.
- Business customers may be charged statutory commercial interest and extrajudicial collection costs in accordance with applicable law.
Article 6 – Delivery and delivery times
- Orders are delivered to the delivery address provided by the customer or to a selected pickup point.
- The customer is responsible for entering the correct address details.
- Current information about processing, shipping and expected delivery times can be found on the Ordering and Shipping page.
- Stated delivery times are expected delivery times, unless a binding delivery date has expressly been agreed.
- If no other delivery period has been agreed with a consumer, the order will be delivered no later than within 30 days.
- If an order is not delivered within the agreed or statutory period, the consumer must first grant SchminkenGrime.nl a reasonable additional period for delivery where required by law.
- An additional period is not required if SchminkenGrime.nl has stated that it cannot or will not deliver, or if it was clear before purchase that delivery on or before a specific date was essential.
- If the agreement is validly terminated due to non-delivery, the amounts paid for that agreement will be refunded.
Article 7 – Risk during shipping
- For consumer orders, SchminkenGrime.nl remains responsible for loss or damage during transport until the consumer, or a third party designated by the consumer who is not the carrier, has received the order.
- If a consumer chooses a carrier that was not offered by SchminkenGrime.nl, the risk may transfer to the consumer at the time determined by law.
- If the customer receives a damaged parcel, an item is missing or something appears to have gone wrong during transport, we ask the customer to report this as soon as possible. Photos of the parcel, packaging and product may help us resolve the issue quickly.
- The request to report transport damage as soon as possible does not limit the statutory rights of a consumer.
Article 8 – Right of withdrawal for consumers
- A consumer who purchases a product through the webshop generally has the statutory right to withdraw from the agreement without giving any reason.
- The withdrawal period is 14 days and starts on the day after the consumer, or a third party previously designated by the consumer who is not the carrier, has received the product.
- If one order consists of several products delivered separately, the period starts on the day after the final product has been received.
- SchminkenGrime.nl provides the legally required online withdrawal function through the webshop. This allows the consumer to withdraw from an agreement during the cooling-off period without being required to use a customer account.
- The online withdrawal function is made clearly and easily accessible on the webshop in accordance with the statutory requirements.
- The consumer may also withdraw by using the model withdrawal form, by emailing info@schminkengrime.nl, or by making another unequivocal statement showing that the consumer wishes to withdraw from the agreement.
- Use of a specific return form is not mandatory.
- If the consumer uses the online withdrawal function, the consumer will receive an electronic confirmation of the withdrawal in accordance with the statutory requirements.
- After notifying SchminkenGrime.nl of the withdrawal, the consumer has another 14 days to return the product.
- The consumer bears the direct costs of returning the product unless SchminkenGrime.nl agrees to bear these costs or the law provides otherwise.
- The risk of a return shipment under the right of withdrawal remains with the consumer until SchminkenGrime.nl has received the returned product. This does not apply where SchminkenGrime.nl itself is responsible for collecting the product.
Article 9 – Handling products during the cooling-off period
- During the cooling-off period, the consumer may inspect and assess a product only to the extent necessary to establish its nature, characteristics and functioning, comparable to what would reasonably be possible in a physical shop.
- If a product has been used beyond what is necessary for such assessment and has therefore decreased in value, the consumer may be liable for this diminished value.
- Opening an outer package does not automatically cause the right of withdrawal to expire.
- The consumer is asked, where reasonably possible, to return products complete and carefully packaged.
- The absence of or damage to the original packaging does not automatically cause the right of withdrawal to expire. If this results in demonstrable diminished value, this may be taken into account when calculating the refund.
Article 10 – Exceptions to the right of withdrawal
The right of withdrawal does not apply where a statutory exception applies. This may include:
- products made to the consumer’s specifications that are not prefabricated but are made on the basis of an individual choice or decision by the consumer, or are clearly intended for a specific person;
- products that are liable to deteriorate rapidly or have a limited shelf life;
- sealed products that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery;
- other products or services for which the law expressly excludes the right of withdrawal.
The right of withdrawal does not automatically expire for cosmetics, face paint, special effects make-up products or contact lenses merely because of the type of product.
If a product has been supplied sealed for reasons of health protection or hygiene and the consumer breaks this seal after delivery, the right of withdrawal for that product may expire.
Where a statutory exception to the right of withdrawal applies to a product, the consumer will be informed of this before purchase.
The mere fact that SchminkenGrime.nl has specially ordered a standard product from a supplier for a consumer does not cause the right of withdrawal to expire.
Article 11 – Refund after withdrawal
- If the consumer validly withdraws from the entire agreement, SchminkenGrime.nl will refund all payments received for that agreement, including the cost of the cheapest standard delivery offered by SchminkenGrime.nl.
- If the consumer chose a more expensive delivery method than the cheapest standard delivery offered, the price difference will not be refunded.
- In the event of partial withdrawal, the refund of any original delivery charges will be determined in accordance with the statutory rules applicable to that situation.
- SchminkenGrime.nl will issue the refund no later than 14 days after the consumer has notified SchminkenGrime.nl of the withdrawal.
- SchminkenGrime.nl may withhold the refund until the product has been received or until the consumer provides evidence that the product has been returned, whichever occurs first.
- Refunds are made using the same payment method used for the original transaction, unless the consumer expressly agrees to another method. No fees will be charged for the refund.
- Any diminished value for which the consumer is legally liable may be deducted from the amount refunded.
Article 12 – Discounts, promotions and free products
- Additional promotional conditions may apply to promotions, discount codes, free products and other offers. These conditions will be communicated with the relevant promotion.
- If a discount depends on a minimum order value and, due to a partial return, the previously communicated promotional conditions are no longer met, the discount may be recalculated.
- If a free product forms part of a promotion that depends on a certain purchase or order value and the conditions are no longer met after withdrawal, the free product may also be returned. If the consumer keeps the free product, its previously clearly communicated value may be deducted.
- Promotional conditions do not limit statutory consumer rights.
Article 13 – Statutory guarantee and defective products
- Consumers are entitled to the statutory guarantee. A delivered product must meet what the consumer may reasonably expect from it under the agreement.
- The Netherlands does not have a general fixed statutory guarantee period. How long a product may reasonably be expected to function properly depends, among other things, on the type of product, the price, the information provided and normal use.
- If a product is damaged, incorrectly delivered or does not meet what the consumer could reasonably expect, the consumer may contact SchminkenGrime.nl.
- If there is a defect for which SchminkenGrime.nl is responsible, the consumer is entitled to the statutory remedies. These may include free repair or replacement and, where the applicable conditions are met, a price reduction or termination of the agreement.
- Repair or replacement will be carried out free of charge and within a reasonable period where the consumer is entitled to it.
- If repair or replacement is impossible, refused, not carried out within a reasonable period, or another statutory ground exists, the consumer may be entitled to a price reduction or termination of the agreement.
- A consumer does not have to report a defect within 48 hours of receipt in order to retain statutory rights. We do, however, ask that visible damage, an incorrectly delivered product or missing items be reported as soon as possible so that we can investigate and resolve the issue quickly.
- Any manufacturer’s warranty or commercial guarantee is in addition to the consumer’s statutory rights and does not limit them.
Article 14 – Product information and images
- SchminkenGrime.nl takes care to provide accurate product descriptions, ingredient information, colours, dimensions, images and other product information.
- Product information may partly be based on information provided by manufacturers and suppliers.
- Colours may appear slightly different in practice due to photography, lighting and display settings.
- Manufacturers may change packaging or design without materially changing the characteristics of the product.
- An error in an image, description or other product information does not limit the statutory rights of a consumer where the delivered product does not conform to the agreement.
- If there is any doubt about whether a product is suitable for a particular application, the customer may contact SchminkenGrime.nl before purchase for advice.
Article 15 – Use and safety of products
- When offering products, SchminkenGrime.nl complies with the applicable statutory obligations relating to product safety.
- The customer uses products in accordance with the product information, instructions for use and any safety warnings.
- Products are used only for purposes for which they are suitable according to the manufacturer and the product information provided.
- Advice from SchminkenGrime.nl is based on the available product information and on the information provided by the customer regarding the intended use.
- If SchminkenGrime.nl establishes or is informed that a product may be unsafe, SchminkenGrime.nl will take the measures required under applicable laws and regulations.
- The customer’s responsibility to use a product correctly does not affect the obligations of SchminkenGrime.nl regarding product safety or the statutory rights of consumers.
Article 16 – Liability
- SchminkenGrime.nl is liable towards consumers for damage to the extent that such damage can legally be attributed to SchminkenGrime.nl.
- Liability that may not be excluded or limited under mandatory law is not excluded or limited by these General Terms and Conditions.
- SchminkenGrime.nl is not liable for damage arising solely because a product is used contrary to the instructions for use, safety information or stated intended use, where such damage cannot be attributed to SchminkenGrime.nl.
- For business customers, the liability of SchminkenGrime.nl is limited to the amount paid out under the liability insurance of SchminkenGrime.nl in the relevant case, plus any applicable deductible that remains for the account of SchminkenGrime.nl under that insurance.
- If the liability insurance does not provide cover or does not make a payment in the relevant case, liability towards a business customer is limited to the invoice amount of the part of the agreement to which the liability relates.
- The limitations for business customers do not apply in the event of intent or deliberate recklessness on the part of SchminkenGrime.nl or where limitation of liability is not permitted by law.
Article 17 – Retention of title
- Delivered products remain the property of SchminkenGrime.nl until all amounts due under the relevant agreement have been paid in full.
- For consumers, retention of title does not alter the transfer of risk described in Article 7.
Article 18 – Gift vouchers
- Gift vouchers issued by SchminkenGrime.nl are valid for at least two years from the date of issue.
- If a longer validity period is stated on the gift voucher, that longer period applies.
- Gift vouchers cannot be exchanged for cash unless this is required by law.
- Any additional conditions of use will be clearly communicated before purchase of the gift voucher.
Article 19 – Business customers
- The statutory right of withdrawal for consumers does not apply to business customers.
- Returns by business customers are only possible with the prior consent of SchminkenGrime.nl, unless the business customer is entitled under the agreement or by law to a remedy for a defective or incorrectly delivered product.
- Products specially ordered or manufactured at the request of a business customer cannot be returned unless otherwise agreed in writing.
- The business customer inspects the delivery within a reasonable period after receipt and reports visible defects or deviations as soon as possible.
Article 20 – Force majeure
- Force majeure exists where SchminkenGrime.nl is temporarily or permanently unable to fulfil an obligation under the agreement due to a circumstance beyond its reasonable control.
- Depending on the circumstances, force majeure may include serious disruptions involving carriers or infrastructure, fire, government measures, war, natural disasters, serious failures of essential business or communication systems and other unforeseen circumstances beyond the reasonable control of SchminkenGrime.nl.
- During a temporary force majeure situation, obligations that cannot be performed as a result are suspended for as long as the force majeure continues.
- This paragraph applies exclusively to agreements with business customers. If a force majeure situation continues for more than 60 days and performance of the agreement remains impossible as a result, both SchminkenGrime.nl and the business customer may terminate in writing the part of the agreement that has not yet been performed. In that case, neither party is liable for damages solely as a result of the termination itself.
- For consumers, statutory rights continue to apply in the event of force majeure. If performance of a consumer agreement becomes permanently impossible and the agreement is therefore terminated, amounts paid for products or services not supplied will be refunded.
Article 21 – Complaints
- A customer with a complaint about an order, product or service may contact SchminkenGrime.nl at info@schminkengrime.nl.
- We ask the customer to preferably provide the order number and a clear description of the complaint. Photos may help where the complaint relates to a damaged or non-conforming product.
- SchminkenGrime.nl will deal with complaints as quickly as reasonably possible and will try to find an appropriate solution together with the customer.
- Use of a particular contact method is not a condition for exercising statutory consumer rights.
Article 22 – Privacy
- SchminkenGrime.nl processes personal data in accordance with applicable privacy legislation.
- More information about the processing of personal data, retention periods and the rights of data subjects can be found in the privacy statement on SchminkenGrime.nl.
- Personal data is used for marketing communications only where there is a valid legal basis for doing so.
- Personal data may be shared with parties necessary for payment, shipping, hosting and other aspects of the service, insofar as permitted under applicable privacy legislation.
Article 23 – Intellectual property
- Texts, photos, videos, designs, logos, illustrations and other original material of SchminkenGrime.nl are protected by intellectual property rights insofar as those rights belong to SchminkenGrime.nl.
- This material may not be copied, published, used commercially or distributed without permission, except where permitted by law.
- If protected material of SchminkenGrime.nl is used without permission, SchminkenGrime.nl may demand that such use cease and may recover damages and reasonable costs that are eligible for compensation under the law.
Article 24 – Applicable law and disputes
- Agreements with SchminkenGrime.nl are governed by Dutch law.
- The choice of Dutch law does not deprive a consumer residing in another country of the protection provided by mandatory consumer rules applicable under international law.
- In the event of a dispute, SchminkenGrime.nl and the customer will first try to resolve the matter between themselves.
- If no solution can be reached, the dispute may be submitted to the court having jurisdiction under the applicable law.
Article 25 – Amendments to the General Terms and Conditions
- SchminkenGrime.nl may amend these General Terms and Conditions for agreements concluded in the future.
- For an agreement already concluded, the General Terms and Conditions that formed part of that agreement at the time it was concluded will continue to apply.
- The most recent version of the General Terms and Conditions is available through SchminkenGrime.nl.
