General Terms and Conditions SchminkenGrime.nl

SchminkenGrime.nl is registered with the Dutch Chamber of Commerce under number 17252421

Article 1. General

1. These general terms and conditions apply to all agreements for the supply of goods and/or services by SchminkenGrime.nl, unless explicitly agreed otherwise in writing, and to all agreements in which SchminkenGrime.nl acts as contractor or supplier.

2. Any general terms and conditions of the Other Party are rejected by SchminkenGrime.nl unless their applicability has been explicitly agreed upon in writing.

3. Not only SchminkenGrime.nl but also all persons and companies involved by SchminkenGrime.nl in the execution of an agreement may invoke these General Terms and Conditions.

Article 2. Offers and Formation of Agreements

1. All offers and/or quotations made by SchminkenGrime.nl are non-binding. An agreement is only formed through the acceptance of a written offer from SchminkenGrime.nl. Any offer from SchminkenGrime.nl is considered rejected if not accepted within one month.

2. If a promotion or offer is made by SchminkenGrime.nl, it becomes void if products are returned and the order no longer meets the conditions. The difference must then be paid to SchminkenGrime. The promotional product may also be returned if it is new, undamaged, and unused.

Article 3: Ordering

All products and services can be ordered via the online store of SchminkenGrime.nl.

Article 4: Special Orders

Items specially ordered for you cannot be exchanged and must be accepted.

Article 5: Prices

All prices are inclusive of VAT and other government-imposed charges but exclude shipping costs.

Article 6: Delivery Time

1. Delivery times indicated in quotations or other agreements are indicative only and do not bind SchminkenGrime.nl. Exceeding the delivery time does not entitle the Other Party to cancel the agreement and/or claim compensation from SchminkenGrime.nl.

2. The delivery of goods by SchminkenGrime.nl depends on production, supply, and other capabilities available at the time of execution.

3. SchminkenGrime.nl aims to deliver goods within 48 hours after receipt of full payment unless otherwise stated or communicated to the customer.

Article 7: Delivery

1. Unless agreed otherwise in writing in advance, deliveries will be made by post. The costs are always charged to the Other Party.

2. Unless agreed otherwise in writing, the transport of goods is at the risk of the Other Party from the moment they leave SchminkenGrime.nl.

3. SchminkenGrime.nl applies two rates for shipping within the Netherlands: €5.95 for standard parcels and €4.95 for letterbox parcels. Orders above €65.00 are shipped free of charge within the Netherlands. For international shipping, costs vary by destination. We recommend contacting us. Orders over €85.00 to Belgium and Germany are shipped free of charge. For the rest of Europe, please contact us.

4. Cash on delivery is not possible.

5. You have the right to cancel your order up to 14 days after receipt without giving any reason. You then have another 14 days to return the product. You will receive a full refund including shipping costs. Only the return costs from your home to our store are at your own expense. These are approximately €7.25 per package. If you use your right of withdrawal, the product must be returned unused, undamaged, and in its original condition and packaging. To use this right, please contact us via klantenservice@schminkengrime.nl. We will refund the order amount within 14 days of your return request, provided the product is received in good order.

6. If packaging of colored lenses, face paint, or makeup has been opened or used, it cannot be returned or claimed. Products are only accepted if unopened, undamaged, and unused. The sender must ensure proper packaging of the return shipment.

7. If a product is out of stock, SchminkenGrime.nl reserves the right to send a replacement or credit the item.

8. The customer is responsible for providing the correct shipping address. If the address is incorrect and the delivery is late or fails, SchminkenGrime.nl reserves the right to resend the package within 30 days. If the customer cancels the order and the address was incorrect, shipping costs will be charged. If the customer is not home and the package returns, SchminkenGrime.nl may redeliver within 30 days or charge shipping costs upon cancellation.

9. If a product is unexpectedly out of stock, SchminkenGrime will notify you by email and propose an alternative, or offer you a replacement or credit depending on the destination.

10. If you want the package delivered to your work address, please include the company name. If not, delivery may fail.

11. Defects must be reported within 48 hours of receipt. After that, SchminkenGrime.nl accepts no responsibility.

12. Gift vouchers are valid for 1 year from the date of issue and are not redeemable for cash.

Article 8: Risk and Ownership Transfer

After delivery, all risks lie with the Other Party. Products remain the property of SchminkenGrime.nl until full payment is received.

Article 9: Product Payment

1. Unless agreed otherwise in writing, products must be paid in full before delivery, or within 14 days after receipt if using post-payment. If payment is not made, SchminkenGrime reserves the right to reclaim products and charge costs.

2. For agreed invoice orders, payment must be made within 8 days. If not, SchminkenGrime has the right to charge €15.00 administration fee per order.

3. Unless agreed otherwise in writing, services require a 50% prepayment and the remaining 50% upon delivery. All payments go directly to SchminkenGrime.nl.

4. In case of late payments, administration, collection, and legal fees may be charged.

5. After 8 days, the customer will receive a reminder. If unpaid, a formal notice will follow. Further failure to pay results in debt collection, with all costs charged to the customer.

Article 10: Payment Methods Netherlands

SchminkenGrime.nl accepts bank transfer (NL78RABO0150167067), online banking, iDEAL, PayPal, MasterCard, Visa, Bancontact, Mister Cash, Giropay, and post-payment (above €75.00). Post-payment is processed via Multisafepay/Multifactor.

Article 11: Shipping and Returns

Regardless of shipment value, SchminkenGrime.nl determines the shipping method. Loading/unloading and transport are at the customer’s risk, unless carried out by SchminkenGrime.nl. Returns must be prepaid. During free shipping promotions, SchminkenGrime.nl decides the method. Once shipped, SchminkenGrime.nl accepts no responsibility for delivery time. Customers are responsible for returns until receipt by SchminkenGrime.nl. Damaged or used items, or opened cosmetic products, will not be accepted. Returns must be registered in advance. If not registered, SchminkenGrime.nl may reject or credit only the product price, excluding shipping. If returns drop the order below the free shipping threshold, shipping costs may be charged retroactively.

Article 12: Packaging

Unless agreed otherwise in writing, goods are delivered in standard packaging as determined by SchminkenGrime.nl. Extra packaging costs requested by the customer are charged to the customer.

Article 13: Liability

1. Liability is limited to the invoice amount for the relevant goods/services.

2. SchminkenGrime.nl is not liable for direct or indirect damages resulting from customer-added branding, texts, or designs.

3. The customer indemnifies SchminkenGrime.nl from third-party claims resulting from non-liable incidents.

Article 14: Termination

1. SchminkenGrime.nl may terminate the agreement in case of force majeure without liability.

2. If the customer fails to fulfill obligations, declares bankruptcy, or suspends payment, SchminkenGrime.nl may suspend or dissolve the agreement without judicial intervention.

3. In such cases, any outstanding amount becomes immediately due. The withdrawal form can be downloaded here.

Article 15: Disputes

Dutch law applies to the relationship between SchminkenGrime.nl and the customer and any resulting disputes.

Article 16: Privacy

Your data is stored to process orders. If you consent, it may also be used for mailings and newsletters. Your data will not be shared with third parties. We comply with privacy regulations.

Article 17: Product Descriptions

All items include a product description based on manufacturer specifications. If information is perceived differently, the customer must contact SchminkenGrime.nl for clarification. If not, SchminkenGrime.nl accepts no responsibility. This also applies to supplier-provided images. Product photos may differ from reality. All images on SchminkenGrime.nl or its related platforms may not be copied or reused without written permission. Unauthorized use may result in a €500.00 fine per image per day if not removed within 3 days after notice.
